Terms and Conditions
Please read these Terms & Conditions before using or placing an order on this site. By using the Twilightez.com website you signify your agreement to the Terms & Conditions set out below. These Terms & Conditions were last updated on the 16th March 2006.
Twilightez.com is owned and operated by Twilight Entertainment Zone, 44 Abbotsford Road, Blackpool, Lancashire, FY3 9RX. Placing an order for goods on Twilightez.com signifies your acceptance of our Terms & Conditions. In these terms "you" and "your" refer to the Customer and "we", "us" and "our" refer to Twilight Entertainment Zone. "This website" and "this site" refers to Twilightez.com.
Order Acceptance
When you place an order with us you will receive a confirmation email within 24 hours. It is your duty to notify us if either you do not receive such an email or if any details within the email are incorrect. It is recommeneded that you should print out a copy of this email for your own records. We cannot be held responsible for any email addresses given to the site by you which are unreachable. At this time you have full rights to cancel your order without any cost; likewise we can cancel the order at our discretion and offer you a full refund. A contract for the sale of product(s) you order from us is only created once we have emailed you a dispatch notice; this will mean we have accepted your order and dispatched your products to the address you have provided us with. Once a dispatch email has been sent you still have the right to cancel your order but doing so may incur some postage charges on your part. After you have placed your order you have seven days in which to cancel without reason. This is in conjunction with your Statutory Rights.
Availability of Goods and Prices
Whilst we make every effort to keep all information on this site 100% accurate and up-to-date, occasionally an error may occur. If a product you have ordered as "Available Now" is not in stock we will email you with the offer of a full refund. If we are expecting to restock the item within 14 days we will offer you the option of either continuing with the order or cancelling to receive a full refund. We cannot offer compensation for any disappointment this may cause. All prices on the site are checked regularly, however if the price of your product is incorrect we will contact you immediately via email. If you are unhappy with the new, correct, price you may cancel the order immediately for a full refund. When we dispatch an order to you we have agreed to sell you the products(s) at the said price, likewise you have agreed to pay the said amount. We will not make any changes to the prices of products which have already been dispatched to you.
Free Gift Wrapping service
Gift wrapping is provided by us as a free service. The colour and design of any papers and tags we use are at our discretion. No returns will be accepted by us for any reasons concerning gift wrap eg. the customer not liking the design or colours, the gift wrap becoming torn inside the packaging or the tag coming loose etc.. Your statutory rights are not affected.
Pre-orders and Items not in stock
When you make payment by cheque or Postal Order for a pre-order item or an item which is out of stock we will not cash your cheque/Postal Order until the item is in stock and ready to be processed unless you ask us specifically to do so.
When you make payment for a pre-order item or an item which is out of stock using credit/debit cards through our secure server or via Paypal using your Paypal account we will not download any monies paid to us into our bank account until your order is in stock and ready to be processed. This means that any monies you have paid to us will not be used by us until your item has been processed. This assures your safety in the case of any item not becoming available or otherwise delayed/deleted.
Return Policy & Faulty Products
If any of the products you receive prove to be faulty you must contact us within 14 days of receiving the item. You will then be asked to return the item(s) to us and we will check the product(s) for the faults you describe. If they are evident we will then send you either a full refund minus the original postage charge or a replacement product posted at our cost. If we cannot find the faults you describe or disagree that what you describe is actually a fault we will deem the item to be unwanted and/or unsuitable and will issue a refund minus original postage costs incurred at the time of ordering and a 20% restocking fee. All items which are being returned as unwanted or unsuitable must be unopened with all original factory packaging and must be in the condition they were in when they left our premises. Any unwanted or unsuitable item must be returned within 7 days and if they meet our requirements ie. they are unopened, unused and/or factory sealed a refund will be given minus original postage charges and a 20% restocking fee. Any postage costs incurred by you both at the time of placing your order or to return any item(s) to us are not refundable as postage costs are charged in order for Royal Mail or other couriers to provide a service and are not classed as part of the original cost of any item(s) for purposes of refund except in the case where an item is out of stock or the order has been cancelled before being dispatched to you. This is in conjunction with your Statutory Rights.
Missing Items
In the event of your order going missing within the postal system the following steps are to be taken. After five working days have passed from receipt of your confirmation email it is advised to check with neighbours and your local sorting office to see if the order has tried to be delivered when you were not available. If it has still not arrived fourteen days after we sent the confirmation email you have to let us know via email and we will begin to pursue a claim through Royal Mail (or other courier). It is your responsibility to fill out and return any forms sent to you by Royal Mail or other courier regarding the order and when they send compensation to us for the missing item(s) you will then be given a full refund. It is your responsibility to ensure you have taken the above steps to find the parcel and to make sure you have given a safe address for delivery purposes. We are not responsible for the theft of your order after it has left our care. Your Conduct on this Site
This site exists for you to have the freedom to browse, purchase products, contact us and submit reviews. We will not accept any unlawful or disruptive behaviour. It is unlawful to: a) Attempt to modify any materials contained in this site. b) Use a credit card which does not belong to you, or to attempt any kind of fraudulent payments. c) Submit reviews of, or contact us with any malicious, profane, slanderous or threatening behaviour.
Any unlawful behaviour will be reported to the relevent authorities. When you visit this site your IP address is made available to us and we will use this information if we feel your use of this site needs to be investigated due to disruptive or illegal behaviour.
Liability
To the fullest extent permissable by law, Twilightez.com is providing this site on an "as is" basis and makes no warranties of any kind with respect to this site or any information, content, materials or products contained in this site. In addition Twilightez.com cannot guarantee that all the information accessible via this site is accurate, complete or current. The products on this site are sold for domestic and consumer use only. Twilightez.com will not be held responsible for any indirect loss, consequential loss, loss of data, loss of income or profit, loss or damage to property and/or loss from claims of third parties arising out of the use of this site or for any products purchased from Twilightez.com.
Complaints
If you have any complaints regarding our service you can contact us via email at complaints@twilightez.com. We aim to respond to complaints within 24 hours via email. Your complaint will be handled by our management and will be dealt with fairly, ethically and without judgement or prejudice.
Electronic Communication
When you send emails to us you are communicating with us electronically. We communicate with you in the same manner. For contractual purposes, you consent to receive communications from us electronically and you agree that all notices, agreements and other communications that we send you electronically satisfy any legal requirements as if such communications were in writing. This does not affect your Statutory Rights.
Events beyond our control
We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay of failure arises from any cause which is beyond our reasonable control, This does not affect your Statutory Rights.
Children
Twilightez.com does not sell products for purchase by children; we sell children's products for purchase by adults. If you are under 18 you may use Twilightez.com with the involvement of a parent or guardian who is over 18 years of age. When you place an order with us you are agreeing you are aged 18 or above.
Customs
When ordering goods from Twilightez.com for delivery overseas you may be subject to import duties and taxes. Any additional charges for customs must be paid by you, we have no control over these charges and cannot specify how much they may be. Customs policies vary widely from country to country and you are advised to seek out further information from your local authorities. It is also your responsibility to make sure the goods you order from us comply with all the laws and regulations of the country in which they are to be received. You should also be aware that some packages delivered outside the UK are subject to random opening and inspection by customs authorities.
Alteration of Terms & Conditions
We reserve the right to make changes to our website, alter our services and change our Terms & Conditions at any time. You will be subject to the Terms & Conditions in force at the time you use or place an order with Twilightez.com, therefore we recommend you print these Terms & Conditions for your own records.
